Every 1031 exchange requires an independent and non-related third party to act as the facilitator of the exchange. The facilitator is referred to as a Qualified Intermediary or QI.
The Internal Revenue Code is very clear on who can and cannot act as a Qualified Intermediary. Any related party (brother, sister, spouse, ancestor or lineal descendant) is not allowed to be your Qualified Intermediary for the exchange.
Any company or individual that is acting as your accountant, attorney, real estate agent/broker or investment advisor is not allowed to be your Qualified Intermediary for the exchange.
Equity 1031, LLC can serve as your Qualified Intermediary because we strictly perform 1031 exchange services.
To maintain our qualification to serve and protect our clients' interest in 1031 exchanges, Equity 1031, LLC does not perform any of the activities that are performed by accountants, attorneys, or by any other excluded advisors.
